These are the general terms and conditions of sale of the Company (hereinafter the “Terms and Conditions of Sale”), which apply to all online sales by the Company and purchases by final consumers for personal use of products offered for sale by the Company (hereinafter the “Products”) on the Company’s website www.hagis.de (hereinafter the “Website”).
The Website is controlled and operated by Hagi’s Grooming GmbH from Germany and is intended for consumers located in the countries and territories to which the Company offers delivery.
The countries and territories currently available for delivery are indicated on the Website and/or during the checkout process. Certain regions or delivery addresses within these countries may be excluded from delivery.
The Company does not deliver to addresses or territories that are excluded on the Website or during the checkout process. Any applicable restrictions relating to P.O. Boxes, military bases, general delivery addresses or other specific delivery locations will be indicated in the relevant shipping information on the Website.
All sales of Products made through the Website are subject to these Terms and Conditions of Sale, which the Customer acknowledges when placing an order.
The Terms and Conditions of Sale applicable to an order are those in force on the date on which the Customer places the order.
The Company reserves the right to amend these Terms and Conditions of Sale with effect for future orders. Any amendments shall not affect contracts already concluded prior to the effective date of the amended Terms and Conditions of Sale.
You are responsible for ensuring that the delivery address provided for your order is located in a country and region to which the Company offers delivery. If you are located outside these countries or regions, you are responsible for arranging the collection or onward shipment of your Product(s) from a location to which the Company offers delivery.
All sales of Products carried out through the Website are subject to these Terms and Conditions of Sale, which the Customer expressly accepts when placing an order. Unless otherwise expressly indicated on the Website, Euro (EUR) is the applicable currency for all orders irrespective of the Customer’s location.
These Terms and Conditions of Sale may be amended or updated by the Company from time to time. The Terms and Conditions of Sale applicable to an order are those in force on the date on which the Customer places the order. Any amendments shall apply only to future orders and shall not affect contracts already concluded.
These Terms and Conditions of Sale should be read together with our Privacy Policy, Cookies Policy, Right of Withdrawal (Cancellation) Policy and Delivery and Returns Policy.
While taking the utmost care to ensure the highest degree of accuracy regarding the information provided on the Products offered for sale on the Website, including categories, names, images, descriptions, properties, characteristics and composition, and regularly updating such information, descriptions and data, the Company cannot exclude the possibility of non-substantial errors.
Furthermore, although photographs and other reproductions of the Products are intended to represent them as faithfully as possible within the limits of the available technical means, minor differences may occur, including differences in colour, appearance or presentation.
Products are offered for sale subject to availability. If, despite the Company’s reasonable efforts, an ordered Product is permanently unavailable, the Company will inform the Customer without undue delay. Where a contract has not yet been concluded, the Company will refrain from accepting the order. Where payment has already been collected, any amounts paid in respect of the unavailable Product will be refunded without undue delay.
The Products offered on the Website are intended for final consumers with a delivery address in one of the countries and territories to which the Company offers delivery, as described in Article 2.
The Products are offered to final consumers exclusively for their private and personal use. The purchase of Products for resale or other commercial purposes beyond personal use is not permitted.
In order to place an order on the Website, the Customer must have reached the age of majority, have full legal capacity and be authorised to use a debit card, credit card or other payment method accepted on the Website at the time the order is placed.
The Customer undertakes to ensure that all information provided to the Company via the Website in connection with an order is accurate, complete and up to date. If the information provided is incorrect, incomplete or outdated, the Company reserves the right, where appropriate, to cancel the order and any corresponding payment.
The Customer is responsible for the consequences resulting from inaccurate, incomplete or outdated information provided to the Company, to the extent permitted by applicable law.
Any personal data and other information provided by the Customer in connection with an order will be processed in accordance with the Company’s Privacy Policy.
The Company is also entitled to refuse an order where (i) there is an outstanding dispute with the Customer concerning payment for a previous order; or (ii) the order does not comply with these Terms and Conditions of Sale, in particular where there are reasonable grounds to believe that the Customer is not purchasing the Products as a final consumer for personal use.
Step No. 1: Selection of the Products
On the Website, the Customer selects the desired Product(s), the required quantity and, where applicable, the relevant size, format or variant, and adds the selected Products to the shopping cart by clicking the “Add to Cart” button.
The presentation of Products on the Website does not constitute a legally binding offer by the Company, but an invitation to the Customer to submit an offer to purchase the respective Products.
Step No. 2: Verification of the Selected Products
The Customer may review and modify the contents of the shopping cart before completing the order. The Customer may remove Products, change quantities or add additional Products.
The prices of the selected Products are automatically displayed in the shopping cart. Product availability and prices may be subject to change until the Customer submits the order. The price applicable to the order is the price displayed at the time the order is submitted.
Step No. 3: Order Validation
Once the Customer has completed their selection and wishes to proceed with the order, the Customer must click the “View Cart”, “Checkout” or equivalent button.
The Customer will then be required to provide the information necessary to process the order, including, in particular:
Where the Website offers the option to create or use a Customer account, the Customer may use the respective account functionality. Where guest checkout is available, the Customer may place an order without creating an account.
The Customer must then select or confirm:
Where available, the Customer may enter a valid promotional or discount code during the checkout process. Promotional codes may provide a discount, gift with purchase or other benefit and are subject to the respective promotional conditions. Further information regarding discount codes, Early Access Codes, offers and promotions can be found in Article 10. of these Terms and Conditions of Sale.
If the conditions applicable to a promotional code or offer are not met, the respective discount or benefit may not be applied or may be automatically removed from the order.
Once all required information has been duly entered, the Customer will be shown the price of the Products, any applicable shipping costs, applicable taxes and the total price of the order.
Before submitting the order, the Customer has the opportunity to review and, where necessary, correct the information provided, including the selected Products, quantities, delivery address, shipping method and payment method.
The Customer is given the opportunity to access and review these Terms and Conditions of Sale and any other legal information relevant to the order before submitting the order.
By clicking the “Pay Now”, “Place Order” or another equivalently and clearly labelled button indicating that the order entails an obligation to pay, the Customer submits a binding offer to purchase the Products contained in the shopping cart.
Once the order has been successfully submitted, the Customer will be provided with an order number.
Step No. 4: Acknowledgement of Receipt and Acceptance of the Order
The Company will acknowledge receipt of the order by sending an e-mail to the e-mail address provided by the Customer. This confirmation e-mail will contain the relevant order and Customer information and, where applicable, information regarding any difficulties concerning the order, including Product availability, delivery or payment.
The acknowledgement of receipt does not constitute acceptance of the Customer’s offer unless expressly stated otherwise in the e-mail.
A binding purchase contract between the Company and the Customer is concluded once the Company expressly accepts the order by sending an order confirmation or dispatch confirmation by e-mail.
Where the Customer has a statutory right of withdrawal, the relevant information concerning the right of withdrawal and its exercise will be provided in accordance with Article 8. of these Terms and Conditions of Sale.
Step No. 5: Dispatch of the Product(s)
Once the ordered Product(s) have been dispatched to the delivery address provided by the Customer, the Company will send the Customer a dispatch confirmation by e-mail.
The prices displayed on the Website are stated in Euro (EUR) and include any applicable statutory value added tax.
Any delivery or additional shipping costs, where applicable, will be displayed to the Customer during the checkout process and before the Customer submits the binding order.
The prices applicable to an order are those displayed on the Website at the time the order is placed.
The Company takes reasonable care to ensure that all prices and other information displayed on the Website are accurate. However, errors cannot be completely excluded. If, after receiving an order, the Company identifies an error in the price or description of a Product ordered by the Customer, the Company will inform the Customer and provide the option to proceed with the order at the correct price or to cancel the order. The Company is not obliged to supply Products at an obviously incorrect price.
The Company reserves the right to adjust prices, offers, Products and Product specifications at any time. Any such changes will not affect Products already ordered and accepted by the Company.
The Customer’s purchases must be paid for using one of the payment methods made available on the Website or during the checkout process.
Payment is processed through secure electronic payment systems and the respective payment service providers used by the Company.
Where payment by credit or debit card is selected, the Customer must provide the card and payment information required to process the transaction during checkout.
The transaction will be processed in accordance with the applicable security standards of the respective payment service provider. The Customer authorises the Company and/or its payment service provider to charge the selected payment method with the total amount of the order, including the price of the Products, applicable taxes and any applicable delivery or additional shipping costs.
If payment cannot be successfully processed or authorised for any reason, including rejection by the Customer’s bank, card issuer or payment service provider, the order may not be processed or may be cancelled.
The Company retains title to the Products until the purchase price has been paid in full.
An invoice will be made available or sent to the Customer electronically in accordance with the options provided on the Website. For questions concerning an invoice, the Customer may contact the Company at info@hagis.de.
Products will be delivered to the delivery address provided by the Customer when placing the order, provided that the address is located within a country or territory to which the Company offers delivery, as described in Article 2.
The Customer is responsible for providing an accurate and complete delivery address in order to avoid delays, failed delivery attempts, returns or additional delivery costs.
Once the Company has accepted the Customer’s order and payment for the ordered Products has been successfully confirmed, the Products will be delivered in accordance with the delivery option selected by the Customer.
The ordered Products will be delivered within the delivery period indicated on the Website or during the checkout process. The indicated delivery times reflect the normal processing and shipping procedure. If a delay occurs, the Company will inform the Customer and, where necessary, provide an updated delivery date.
The risk of accidental loss of or damage to the Products passes to the Customer when the Products are physically delivered to the Customer or to a third party designated by the Customer other than the carrier.
If Products are delivered with visible transport damage, the Customer is requested to report such damage to the carrier as soon as reasonably possible and to contact the Company. Failure to make such a report or contact the Company does not affect the Customer’s statutory rights, including any statutory warranty rights.
The Customer has the right to withdraw from a contract concluded through the Website within fourteen (14) days without giving any reason.
The withdrawal period is fourteen (14) days from the day on which the Customer, or a third party designated by the Customer other than the carrier, takes physical possession of the Products. In the case of multiple Products ordered in a single order and delivered separately, the withdrawal period begins on the day on which the Customer, or a third party designated by the Customer other than the carrier, takes physical possession of the last Product.
To exercise the right of withdrawal, the Customer may use one of the following methods:
(i) Cancellation function available on the Website
The Customer may exercise the right of withdrawal directly through the dedicated cancellation function available on the Website.
To do so, the Customer must click “Cancellation” in the footer of the Website and follow the steps provided.
The Customer may be asked to provide or confirm the information necessary to identify the relevant order, including, where applicable, the order number, e-mail address and any other information requested on the Website.
Once the withdrawal has been submitted through the cancellation function, the Company will acknowledge receipt of the withdrawal without undue delay on a durable medium, such as by e-mail. The confirmation will include the information relating to the withdrawal as well as the date and time of its submission.
(ii) By any other unequivocal statement
The Customer may also exercise the right of withdrawal by sending the Company an unequivocal statement expressing the decision to withdraw from the contract.
Such statement may be sent to:
Hagi’s Grooming GmbH
Scheibenstraße 45
40479 Düsseldorf
Germany
E-mail: info@hagis.de
No reason for the withdrawal is required.
To meet the withdrawal deadline, it is sufficient for the Customer to send the communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
Products purchased through the Website cannot be returned in-store unless expressly agreed otherwise by the Company. Products must be returned in accordance with the return procedure communicated by the Company.
The Customer may return the Products by post or courier to the return address provided by the Company. The Customer is advised to retain proof of dispatch until the return has been completed.
The Customer bears the direct costs of returning the Products, unless otherwise stated by the Company or unless the return results from an incorrect, defective or otherwise non-conforming delivery for which the Company is responsible.
The Customer is only liable for any diminished value of the Products resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the Products.
Following the exercise of the right of withdrawal, the Customer must return the Products without undue delay and in any event no later than fourteen (14) days from the day on which the Customer informs the Company of the decision to withdraw. The deadline is met if the Products are dispatched before the fourteen-day period has expired.
Where reasonably possible, Products should be returned together with their original packaging, accessories and any documents supplied with them. The absence of the original packaging does not in itself affect the Customer’s statutory right of withdrawal.
The risk of the return shipment remains with the Customer until the Products have been received by the Company, unless otherwise provided by applicable law.
Following a valid withdrawal, the Company will reimburse all payments received from the Customer, including the cost of the least expensive standard delivery method offered by the Company. Any additional costs resulting from the Customer having selected a more expensive delivery method will not be reimbursed.
Reimbursement will be made without undue delay and no later than fourteen (14) days from the day on which the Company is informed of the Customer’s decision to withdraw. The Company may withhold reimbursement until it has received the Products back or until the Customer has provided evidence that the Products have been returned, whichever occurs first.
Unless expressly agreed otherwise, reimbursement will be made using the same payment method used for the original transaction. The Customer will not incur any fees as a result of the reimbursement.
The statutory right of withdrawal does not apply, in particular, to:
sealed Products which are not suitable for return for reasons of health protection or hygiene where the seal has been removed after delivery.
Any designation of a Product as “final sale”, “non-returnable” or similar does not limit any mandatory statutory rights of the Customer.
The Customer is entitled to the statutory rights in respect of defective or non-conforming Products in accordance with the applicable legal provisions.
For Customers in Germany, the statutory warranty rights apply in particular in accordance with §§ 434 et seq. of the German Civil Code (BGB).
Where the Customer is a consumer residing in another country, any mandatory consumer protection and statutory warranty rights applicable under the laws of that country remain unaffected by these Terms and Conditions of Sale.
Customers may occasionally receive discount codes, Early Access Codes or other promotional codes from the Company by e-mail, through the Website or through other promotional activities. Specific terms and conditions may apply to individual codes. Codes are non-transferable, have no monetary value and cannot be redeemed for cash. A code may have an expiry date, which will be indicated in connection with the respective promotion or accompanying promotional materials.
Early Access Codes may allow selected Customers to access and purchase certain Products, product launches, collections or sales events before they become available to the general public. Early Access applies only during the specified Early Access period and to the Products made available as part of the respective Early Access event. Products remain subject to availability and an Early Access Code does not guarantee the availability or purchase of any particular Product.
Where an order containing multiple Products is placed using a discount code, the value of the discount may be allocated proportionally across the Products covered by the promotion. Any refund relating to an individual Product will be reduced by the proportion of the discount attributable to that Product. The discount itself will not be refunded or paid out separately.
A discount code, Early Access Code or other promotional code cannot be used if it is invalid, expired or if the applicable promotional conditions have not been fulfilled. The Customer is not entitled to receive a replacement code.
Unless expressly stated otherwise in connection with the relevant promotion, only one discount code may be used per order. Multiple discount codes or promotional offers generally cannot be combined.
Certain Products or Product categories may be excluded from discounts, Early Access events, special offers or other promotions. Any applicable exclusions or additional conditions will be stated in connection with the respective promotion.
Unless expressly stated otherwise, discount codes do not apply to Products that have already been reduced in price or are subject to another promotional offer.
All intellectual and industrial property rights relating to the Website and its contents, including but not limited to trademarks, trade names, logos, texts, illustrations, photographs, images, graphics, videos, designs, product designs, models, software, databases and other materials displayed or made available on the Website, are the property of the Company or are used by the Company under appropriate licences or other rights.
Nothing in these Terms and Conditions of Sale shall be construed as granting the Customer any right, title, licence or interest in or to any trademarks, copyrights, designs, trade names, Products, distinctive signs or other intellectual property rights belonging to or used by the Company.
Except where permitted by applicable law, the reproduction, distribution, public communication, making available, modification, adaptation or other exploitation of any content of the Website, whether for commercial or other purposes, is prohibited without the prior consent of the Company or the respective rights holder.
The Company expressly reserves its rights in relation to the use of content available on the Website for text and data mining to the extent permitted by applicable law, including pursuant to § 44b of the German Copyright Act (UrhG).
The Company processes personal data provided by the Customer in connection with the use of the Website and the placing and processing of orders. Such data may include, in particular, the Customer’s name, e-mail address, telephone number, billing and delivery address and other information necessary to process an order.
Personal data is processed only to the extent necessary for the purposes described in the Company’s Privacy Policy and in accordance with applicable data protection laws. Where necessary for the processing and fulfilment of an order, personal data may be transmitted to service providers engaged by the Company, including payment service providers, logistics providers and other service providers involved in the performance of the contract.
Payment information may be processed directly by the respective payment service provider. The Company does not necessarily receive or store complete payment card details.
Further information regarding the collection, processing and protection of personal data and the Customer’s rights can be found in the Company’s Privacy Policy.
The Company shall be liable without limitation for damages resulting from intentional or grossly negligent breaches of duty by the Company, its legal representatives or vicarious agents.
The Company shall also be liable without limitation for damages resulting from injury to life, body or health caused by an intentional or negligent breach of duty by the Company, its legal representatives or vicarious agents.
In the event of a slightly negligent breach of material contractual obligations, the Company’s liability shall be limited to the foreseeable damage typical for the contract. Material contractual obligations are obligations whose fulfilment is essential for the proper performance of the contract and on the fulfilment of which the Customer may regularly rely.
The above limitations of liability shall also apply in favour of the Company’s legal representatives and vicarious agents where claims are asserted directly against them.
The above limitations of liability shall not apply where the Company has fraudulently concealed a defect or has assumed a guarantee regarding the quality of a Product. Mandatory statutory liability provisions, including those under the German Product Liability Act (Produkthaftungsgesetz), remain unaffected.
The Customer’s statutory rights in respect of defective Products remain unaffected.
The Company shall not be liable for delays or failure to perform contractual obligations to the extent that such delay or failure results from events beyond the Company’s reasonable control and whose consequences could not reasonably have been prevented despite the exercise of appropriate care.
Such events may include, in particular, natural disasters, war, terrorist acts, civil unrest, government measures, trade or import restrictions, pandemics, strikes, blockades, significant disruptions to transport routes or supply chains, failure of essential infrastructure or other comparable events for which the Company is not responsible.
The Company will inform the Customer as soon as reasonably possible of any material delay affecting the Customer’s order as a result of such an event.
If such an event continues and the order cannot be fulfilled within a reasonable period, the Customer shall be entitled to withdraw from the contract in accordance with applicable law. Any payments already made for Products that have not been delivered will be reimbursed without undue delay.
The Customer’s mandatory statutory rights remain unaffected.
Should any provision of these Terms and Conditions of Sale be or become wholly or partially invalid or unenforceable, the validity of the remaining provisions shall not be affected.
The applicable statutory provisions shall apply in place of any invalid or unenforceable provision.
These Terms and Conditions of Sale and all contractual relationships between the Company and the Customer shall be governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
Where the Customer is a consumer and has their habitual residence in another country, the choice of German law shall not deprive the Customer of the protection afforded by mandatory provisions of the law of the country in which the Customer has their habitual residence.
If the Customer is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising out of or in connection with the contractual relationship shall be Düsseldorf, Germany.
The Company is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
